1. Introduction
These Terms of Service (“Terms”) govern your access to and use of products and services provided by EPM Mobile Inc. (“StarPOS,” “we,” “us,” or “our”), including the StarPOS software, hardware, and related services (collectively, the “StarPOS Services”). By using the StarPOS Services, you agree to these Terms. If you disagree, do not use the Services.
“StarPOS” refers to EPM Mobile Inc., located at 413 Commonwealth Ave, Catonsville, MD 21228. “Location” means the United States of America, where EPM Mobile Inc. is incorporated.
2. Accepting the Terms; Use of StarPOS Services
2.1 Acceptance
By using StarPOS Services or clicking “Accept,” you agree to these Terms and form a binding contract with EPM Mobile Inc. You represent authority to bind your business.
2.2 Account Creation
After acceptance, StarPOS will provide credentials to create a StarPOS Account. You must provide accurate, current, and complete business information (“Account Information”). Inaccurate data may result in termination of your access.
2.3 Third-Party Apps
The StarPOS Services may link to third-party applications (“Apps”) via the StarPOS App Marketplace. Apps are not part of StarPOS Services, and you are solely responsible for their use, fees, and compliance with developer agreements.
2.4 Compliance
You agree to follow all StarPOS guidelines, including the StarPOS App Marketplace Terms.
3. License Grant
StarPOS grants you a limited, non-exclusive, revocable license to use the Services for internal business purposes within the Location.
4. Restrictions
You may not:
(a) Access unauthorized parts of the Services;
(b) Use time-sharing or service bureau arrangements;
(c) Use Services outside the Location without written consent;
(d) Disrupt Services or infrastructure;
(e) Use Services beyond permitted scope.
5. Fees and Payments
You agree to pay all applicable fees and taxes. StarPOS may change fees with 30 days’ notice. Disputes must be submitted in writing within 30 days.
6. Privacy and Data Use
6.1 Data Collection
StarPOS collects data as described in the StarPOS Privacy Policy.
6.2 Compliance
You must comply with privacy laws (e.g., CCPA, TCPA) and implement security measures for customer data.
6.3 Third-Party Sharing
By installing Apps, you authorize StarPOS to share data with developers. You are responsible for managing these permissions.
7. Intellectual Property
All rights to StarPOS Services, trademarks, and software remain with EPM Mobile Inc. or licensors. You may not reverse-engineer or modify the Services.
8. Termination
StarPOS may terminate your access immediately for violations. Upon termination, cease all use and export data promptly.
9. Disclaimers and Liability
Services are provided “AS IS.” StarPOS disclaims all warranties. Liability is limited to fees paid in the prior three months.
10. Indemnity
You indemnify StarPOS against claims arising from your misuse, violations of law, or third-party services.
11. Governing Law
These Terms are governed by Maryland law. Disputes will be resolved in courts of Baltimore County, MD.

Additional Provisions
- Amendments: StarPOS may update these Terms with reasonable notice.
- Assignment: You may not assign rights without StarPOS’s consent.
- Survival: Sections on liability, privacy, and indemnity survive termination.
Food Ordering Program (if applicable)
By using StarPOS’s food ordering features, you agree to comply with alcohol laws, age verification, and data handling rules.
Acknowledgment
By using StarPOS Services, you confirm acceptance of these Terms.
